Terms of sale
Terms applicable from 19 October 2026. The French version of these terms is the authoritative one.
1. Scope
These general terms of sale apply to sales of original works by Beata Wiśniewska-Kowalewska, Atelier BWK (“the Atelier”), to any buyer (“the Buyer”), whether concluded at a distance (email, phone, messaging) or at the studio.
The site atelierbwk.com presents the works but does not allow ordering or paying online. Every sale is arranged directly with the artist.
2. The seller
Beata Wiśniewska-Kowalewska, Atelier BWK, sole trader (entrepreneur individuel, EI), 16 rue du Maréchal de Lattre de Tassigny, 85770 Vix, France. SIRET 923 134 845 00018. Contact: atelierbwk@gmail.com, +33 6 37 41 05 01.
3. The works
Each work is a unique original, signed by the artist, with a certificate of authenticity and an identification number. Unless stated otherwise, the edges are painted, the work is ready to hang without a frame, and no frame is included.
Photographs and descriptions are as faithful as possible. Colours, texture and light effects (especially metallic or fluorescent paints) may still look different depending on the screen and lighting; feel free to ask for more photos or a video before buying.
4. Prices
Prices are in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. Delivery costs are added and are stated before the sale is concluded (about €50 within Europe, on quotation elsewhere).
The applicable price is the one confirmed in writing at the time of sale. A work marked “in a private collection” is no longer available.
5. How a sale is concluded
- The Buyer expresses interest in a work (form, email, phone).
- The Atelier sends a written proposal setting out the work, the price, delivery costs and time, payment methods and a link to these terms.
- The sale is concluded when the Buyer accepts this proposal in writing. The Atelier acknowledges it and reserves the work.
A work can be reserved for a few days pending payment; after the agreed period, the reservation ends.
6. Payment
Payment is made by bank transfer, PayPal, or cash at the studio within the limits set by law. The work is shipped or handed over once full payment has been received.
The Atelier remains the owner of the work until the price has been paid in full.
7. Delivery
The work is carefully packed and shipped within 48 working hours of receipt of payment, unless another time is agreed, and in any case within 30 days. Collection from the studio is possible by appointment.
The risk of loss or damage passes to a consumer Buyer when they take physical possession of the work. Please check the parcel on arrival and, if it is damaged, report it to the carrier and to the Atelier as soon as possible, with photos.
8. Right of withdrawal
When the sale is concluded at a distance with a consumer, the consumer has 14 days from receipt of the work to withdraw, without giving any reason.
To do so, simply inform the Atelier of the decision by a clear statement (by email to atelierbwk@gmail.com or by post), for example using the form in the appendix.
The work must be sent back within 14 days of that statement, in its original condition, with its certificate of authenticity, carefully packed. Return costs are paid by the Buyer; insured shipping is strongly recommended.
The Atelier refunds all payments received, including the original delivery costs (up to the standard rate), within 14 days of receiving the withdrawal decision, using the same means of payment. The refund may be withheld until the work has been received back.
The right of withdrawal does not apply to works made to order to the Buyer’s specifications, nor to sales concluded and delivered at the studio.
9. Legal guarantees
A consumer Buyer benefits from the legal guarantee of conformity (French Consumer Code, articles L.217-3 to L.217-20) and the guarantee against hidden defects (French Civil Code, articles 1641 to 1649).
The consumer has two years from delivery to invoke the legal guarantee of conformity if a lack of conformity appears. During this period the consumer only has to show that the lack of conformity exists, not when it appeared. The guarantee entitles the consumer to have the item repaired or replaced within thirty days of the request, free of charge and without major inconvenience; failing that, to a price reduction or to cancel the contract. A professional who in bad faith obstructs this guarantee is liable to a civil fine. The consumer also benefits from the legal guarantee against hidden defects for two years from discovery of the defect, giving the right to a price reduction or to cancel the sale.
As every work is unique, replacement is generally not possible: the Atelier will offer a repair (restoration by the artist) or, failing that, a price reduction or a refund.
10. Intellectual property
The purchase transfers ownership of the physical work. Copyright (reproduction, display, distribution) remains with the artist. The Buyer may photograph the work for private purposes; any public or commercial reproduction requires the artist’s written consent. The artist keeps the right to reproduce images of the work to present her practice.
11. Personal data
Data needed for the sale is processed as described on the Privacy and cookies page.
12. Complaints, mediation and applicable law
For any question or complaint, contact the Atelier at atelierbwk@gmail.com: we always look for an amicable solution.
These terms are governed by French law. A consumer living in another EU country keeps the protection of the mandatory provisions of the law of their country of residence. In the event of a dispute, the consumer may bring proceedings before the court of the place where they lived at the time of the sale or of the harmful event.
